1. GENERAL

These Terms and Conditions, together with our Privacy Policy (collectively, the "Terms"), form a legally binding agreement between you ("you" or "user") and UAB "Kinelija", a company based in Vilnius, Lithuania ("we", "us", or "Kinelija").
By downloading, installing, accessing, or using any of our games, applications, content, or services (collectively, the "Service"), including via third-party platforms (e.g., Google Play, Apple App Store, or social networks), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
You must be at least **13 years old** to use the Service. If you are between 13 and 18, you must obtain permission from a parent or legal guardian. Parents/guardians are responsible for supervising minors’ use and agree to these Terms on their behalf.

The Service is free to use. You may receive daily free credits (e.g., tokens, coins) to play. Unused free credits may expire daily (as indicated in-game), unless otherwise stated.
Certain features, levels, or content may require paid credits ("coins", "gems", etc.), purchasable via in-app purchases (IAP) through Apple App Store, Google Play, or other approved payment methods.
All purchases are processed by the respective platform (Apple/Google). We do not collect or store your payment details. You are responsible for applicable taxes and fees.
Important: — Credits (free or paid) and in-game items have **no real-world monetary value**. — They cannot be redeemed for cash, transferred, sold, or exchanged outside the Service. — All purchases are **non-refundable**, except where required by law (e.g., EU consumer right of withdrawal). — We reserve the right to reset, revoke, or modify accounts/currency in cases of fraud, bugs, or abuse.

Where the Service includes forums, chats, or comment features ("Communication Tools"), any content you submit (text, names, avatars, etc.) is considered "User Content".
You agree not to submit User Content that is:
1. defamatory, obscene, hateful, threatening, or discriminatory;
2. infringing third-party rights (e.g., copyright, privacy);
3. promoting illegal activity, spam, or commercial ventures;
4. containing personal data of others (e.g., real names, contact info);
5. false, misleading, or damaging to Kinelija or its reputation.
We may, but are not obligated to, monitor, edit, or remove User Content at our sole discretion. You may report inappropriate content via in-game tools or by emailing us.
You grant us a **non-exclusive, worldwide, royalty-free, sublicensable licence** to use, display, and distribute your User Content solely in connection with operating and promoting the Service.
You warrant that you own or have rights to all User Content you submit and that it complies with these Terms.

You agree to use the Service only for lawful, personal, non-commercial purposes, and not to:
1. violate any applicable laws (including export controls or sanctions);
2. reverse-engineer, decompile, or tamper with the Service;
3. use bots, scripts, or automation to gain unfair advantage;
4. distribute malware or disrupt the Service’s operation;
5. impersonate others or create multiple accounts to abuse promotions.
Violation may result in warnings, temporary/permanent bans, removal of content, or legal action — at our discretion.

All rights in the Service — including code, graphics, music, characters, names, and logos — are owned by or licensed to UAB "Kinelija" and protected by copyright, trademark, and other laws.
You receive a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.
You may not copy, modify, distribute, or create derivative works without our prior written permission.

The Service may include links to third-party websites or ads. These are for convenience only.
We do not endorse or control third-party content. You use them at your own risk.
Review third-party terms and privacy policies before engaging with external services.

No warranty: The Service is provided "as is", without warranties of merchantability, fitness for purpose, or non-infringement.
Limitation of liability: To the fullest extent permitted by law (including Lithuanian and EU law), Kinelija shall not be liable for:
1. any indirect, incidental, or consequential damages;
2. loss of data, profits, or goodwill;
3. service interruptions, bugs, or account/data loss (including due to platform outages).
Nothing in these Terms excludes or limits liability for: — death or personal injury caused by negligence; — fraud or fraudulent misrepresentation; or — any liability that cannot be lawfully excluded (e.g., mandatory consumer rights under EU law).
We are not responsible for actions or policies of app stores (Apple/Google) or social platforms.

You agree to indemnify and hold harmless Kinelija and its affiliates from any claims, damages, or expenses (including legal fees) arising from your:
1. breach of these Terms;
2. unauthorised use of the Service;
3. infringement of third-party rights.

These Terms are governed by the laws of the **Republic of Lithuania**, without regard to conflict of law principles.
Any disputes shall be subject to the **exclusive jurisdiction of the courts of Vilnius, Lithuania**.
For EU consumers: Nothing in this clause affects your rights under mandatory EU consumer protection laws.

We may update these Terms at any time. Changes take effect upon posting. Continued use constitutes acceptance.
We may suspend or discontinue the Service (in whole or part) at any time, with or without notice.
You may stop using the Service at any time. Upon termination, all licences granted herein cease.
